1. Acceptance of Terms
By accessing or using ViolationNet ("Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Description of Service
ViolationNet provides code violation monitoring services by aggregating publicly available data from municipal open data portals. The Service allows users to:
- Search for code violations by address
- Monitor properties for new violations
- Receive email alerts when violations are detected
- Export violation data (paid plans)
3. Account Registration
To use certain features of the Service, you must register for an account. You agree to:
- Provide accurate and complete information
- Maintain the security of your password
- Accept responsibility for all activities under your account
- Notify us immediately of any unauthorized use
4. Subscription and Billing
Paid subscriptions are billed monthly or annually via Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis.
- Free Trial: Pro and Portfolio plans include a 14-day free trial. You will not be charged until the trial ends.
- Cancellation: You may cancel your subscription at any time. Access continues until the end of the current billing period.
- Refunds: We do not provide refunds for partial billing periods.
- Price Changes: We may change prices with 30 days notice. Existing subscriptions continue at the current rate until renewal.
5. Data Accuracy Disclaimer
IMPORTANT: ViolationNet aggregates data from public municipal sources. We do not guarantee:
- The accuracy, completeness, or timeliness of violation data
- That all violations will be detected or reported
- That data reflects the current status of any violation
You should independently verify any violation information with the relevant municipal authority before taking action. ViolationNet is not a substitute for professional legal, real estate, or compliance advice.
6. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Attempt to gain unauthorized access to any part of the Service
- Scrape, crawl, or use automated means to access the Service beyond normal API usage
- Resell or redistribute Service data without authorization
- Interfere with or disrupt the Service or servers
7. Intellectual Property
The Service, including its design, features, and content (excluding public violation data), is owned by ViolationNet and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without permission.
8. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VIOLATIONNET SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO:
- Loss of profits, revenue, or business opportunities
- Fines, penalties, or legal fees resulting from undetected violations
- Property damage or diminished property value
- Any damages arising from reliance on Service data
Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
9. Indemnification
You agree to indemnify and hold harmless ViolationNet from any claims, damages, or expenses arising from your use of the Service or violation of these Terms.
10. Termination
We may suspend or terminate your account at any time for violation of these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ceases immediately.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email or in-app notification. Continued use of the Service after changes constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Delaware.
